52-2-403. General duties of the department. The department is hereby authorized and directed to:
     (1) issue licenses to persons now acting as agencies for procuring the adoption of minor children or who may desire to operate as such agency in the future;
     (2) prescribe the conditions upon which such licenses shall be issued; and
     (3) make such rules for the conduct of the affairs of such agencies as are consistent with the welfare of such minor children.
