A Bill for an Act entitled: "An Act expanding the authority of a board of county commissioners to adopt ordinances, rules, and regulations; and amending section 7-5-2101, MCA."



Be it enacted by the Legislature of the State of Montana:



Section 1.  Section 7-5-2101, MCA, is amended to read:

"7-5-2101.   General authority of county commissioners. (1) The board of county commissioners has the jurisdiction and power, under such subject to any limitations and restrictions as are prescribed by law, to represent the county, and have the to care of the for county property, and the management of and to manage the business and concerns of the county in all cases where no other provision is made by law.

(2)  The board has the jurisdiction and power, under such subject to any limitations and restrictions as are prescribed by law, to perform all other acts and things required by law not enumerated in this title or which that may be necessary to the full discharge of the duties of the chief executive authority of the county government.

(3) The board has the power to adopt ordinances, rules, and regulations and to take any other actions that are not inconsistent with state law that the board considers necessary to protect the public health, safety, and welfare or to efficiently carry out county business. The powers granted to the board in this subsection must be liberally construed."
