A Joint Resolution of the Senate and the House of Representatives of the state of Montana requesting an interim study of state property management; and providing for a report of findings to the Governor and 56th Legislature.



WHEREAS, the state owns numerous buildings that are not under the control of a professional property manager; and

WHEREAS, these buildings have maintenance and capital improvement needs that may not be recognized by the occupants; and

WHEREAS, these properties are significant assets to the state and require proper care; and

WHEREAS, it is difficult for state agencies to follow statutory requirements to colocate with other agencies in other cities because of existing property management practices and space availability issues; and

WHEREAS, aging state buildings may be depreciated and in need of sale, containment, or demolition, and changes in government service delivery may cause some state buildings to be declared surplus; and

WHEREAS, the Legislature has not studied these real property issues; and

WHEREAS, to best serve the public, the Legislature should conduct a thorough study of state property management practices and should explore alternative ways to address state property management issues.



NOW, THEREFORE, BE IT RESOLVED BY THE SENATE AND THE HOUSE OF REPRESENTATIVES OF THE STATE OF MONTANA:

That an appropriate interim committee be assigned to study:

(1) the need for changing maintenance policies for state-owned buildings not managed by a professional facility manager;

(2) the desirability of colocating agencies in facilities outside of Helena and methods to promote and ensure that colocation is accomplished; and

(3) the disposition of surplus and depreciated real property.

BE IT FURTHER RESOLVED, that the Legislative Council be encouraged to accept any funding that may be available from the Executive Branch of state government for the purposes of the interim committee.

BE IF FURTHER RESOLVED, that the interim committee report its study findings to the Governor and the 56th Legislature in time for budget recommendations to the 56th Legislature.
