A Bill for an Act entitled: "An Act allowing supervised residents of licensed long-term care facilities, NURSING CARE FACILITIES, PERSONAL CARE FACILITIES, AND COMMUNITY HOMES FOR PERSONS WITH DISABILITIES to fish without a license UPON ANNUAL APPLICATION BY MANAGERS OR DIRECTORS OF THE FACILITIES AND HOMES; amending section 87-2-802, MCA; and providing an applicability date."



Be it enacted by the Legislature of the State of Montana:



Section 1.  Section 87-2-802, MCA, is amended to read:

"87-2-802.   Veterans in VA hospitals and residents of state institutions and long-term care facilities, NURSING CARE FACILITIES, PERSONAL CARE FACILITIES, AND COMMUNITY HOMES FOR PERSONS WITH DISABILITIES. (1) Any veteran who is a patient residing at a hospital operated by the department of veterans affairs, within or outside the state, supervised residents of a licensed long-term care facility, as defined in 50-5-101, and residents of all institutions under the jurisdiction of the department of corrections and the department of public health and human services, except the Montana state prison at Deer Lodge or the women's correctional system, will be are entitled to fish without a license. The residents shall carry a permit on a form prescribed by the department and signed by the superintendent of the institution in lieu of a license.

(2) UPON ANNUAL APPLICATION BY MANAGERS OR DIRECTORS OF LICENSED LONG-TERM CARE FACILITIES AND PERSONAL CARE FACILITIES AS DEFINED IN 50-5-101, COMMUNITY HOMES FOR PERSONS WITH DEVELOPMENTAL DISABILITIES LICENSED UNDER 53-20-305, AND COMMUNITY HOMES FOR PERSONS WITH SEVERE DISABILITIES LICENSED UNDER 52-4-203, THE DEPARTMENT SHALL ALLOW SUPERVISED RESIDENTS TO FISH WITHOUT THE OTHERWISE REQUIRED LICENSE DURING ANY ACTIVITIES APPROVED BY THE FACILITIES AND HOMES."



NEW SECTION. Section 2.  Applicability. [Section 1] applies to license years beginning March 1, 1998.
