     7-14-2704. Resolution of public interest. (1) Upon receipt of the petition, the board may pass a resolution that the public interest demands the laying out, opening, constructing, or improving of the road or part of the road described in the resolution.
     (2) The description may not include a portion of a road within the boundaries of a city or incorporated town.
