     7-3-4461. Department of law. (1) The head of the department of law shall be an attorney at law who has been admitted to practice in the state of Montana and shall be known as the city attorney.
     (2) He shall be the legal adviser of and attorney and counsel for the municipality and for all the officers and departments thereof in matters relating to their official duties. He shall prosecute and defend all suits for and in behalf of the municipality and shall prepare all contracts, bonds, and other instruments in writing in which the municipality is concerned and shall endorse on each his approval of the form and correctness thereof. He shall have such other duties and authority as are now conferred upon the city attorney by existing laws.
     (3) He shall have such number of assistants as the commission by ordinance may authorize.
