     70-23-202. Notice of intention to sell by developer -- fees. (1) The developer of a project shall notify the department in writing prior to the time the project or units thereof are to be offered for sale.
     (2) The notice of intention to sell shall fully disclose all material facts on a form prescribed by the department.
     (3) The fee for filing the notice of intention is $50. For the inspection of the project and examination of the accounts and records of the developer, the department may require the developer to pay the costs thereof, not to exceed the sum of $100 for each day actually required to perform such duties, but in no event shall the total charges exceed the sum of $500.
