     19-9-1102. Payments in absence of spouse or child. If a retired member dies without leaving a surviving spouse or dependent child and if the member had designated a beneficiary in writing to the board as provided in 19-2-801, the designated beneficiary must be paid the amount, if any, of the member's accumulated contributions minus the total of any retirement benefits already paid from the member's account. If the member did not designate a beneficiary or the designated beneficiary predeceased the member, the amount must be paid to the member's estate.
