     69-14-133. Collection and disposition of penalties and forfeitures. Unless otherwise provided in this chapter, all penalties and forfeitures under the provisions of this chapter must be collected by the commission, paid to the state, and credited to the general fund. If the commission fails or refuses to institute appropriate action for the recovery of any penalty or forfeiture provided for in this chapter for 60 days after notice of the cause of complaint by an aggrieved person or shipper, the person or shipper may institute and prosecute an action in the name of the state against the railroad, in the same manner as the commission.
