AN ACT ELIMINATING LICENSING PROCEDURES FOR PORTABLE SAWMILLS ON FOREST LANDS; REPEALING SECTIONS 76-13-501, 76-13-502, 76-13-503, 76-13-504, 76-13-505, 76-13-506, AND 76-13-507, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.



     WHEREAS, the law regulating portable sawmills on forest lands was enacted in 1931; and

     WHEREAS, the licensing of portable saw mills was an active protection program in the 1940s and 1950s, with hundreds of portable sawmill licenses issued annually; and

     WHEREAS, since 1980, there has been a total of nine licenses issued, with only three of those in the last 9 years; and

     WHEREAS, the Legislative Audit Division has recommended that executive agencies recommend legislation to repeal archaic and obsolete state laws.

     THEREFORE, the Legislature of the State of Montana finds it appropriate to repeal this archaic and obsolete state law.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Repealer. Sections 76-13-501, 76-13-502, 76-13-503, 76-13-504, 76-13-505, 76-13-506, and 76-13-507, MCA, are repealed.



     Section 2.  Effective date. [This act] is effective on passage and approval.
