A BILL FOR AN ACT ENTITLED: "AN ACT CREATING THE MONTANA RAIL PASSENGER BOARD; ESTABLISHING BOARD MEMBERSHIP AND TERMS OF APPOINTMENT; PROVIDING FOR BOARD DUTIES; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A TERMINATION DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Montana rail passenger board -- membership -- duties. (1) There is a Montana rail passenger board.

     (2) The board consists of nine members appointed by the governor as follows:

     (a) three members representing railroad companies that operate in the state;

     (b) three members representing the general public; and

     (c) three members representing the department of transportation, including:

     (i) the director or the director's designee;

     (ii) a member of the transportation commission provided for in 2-15-2502; and

     (iii) an employee of the rail, transit, and planning division of the department of transportation.

     (3) Members must be appointed for 5-year terms, except that four members initially appointed shall serve terms of 3 years. If a vacancy occurs, the governor shall appoint a replacement to fill the unexpired term according to the provisions of subsection (2). A member may be reappointed.

     (4) The board shall elect a presiding officer from its members and may meet as often as is necessary to conduct its business, but at least twice annually.

     (5) The members shall serve without pay. The members are entitled to reimbursement for travel, meals, and lodging while engaged in board business, as provided in 2-18-501 through 2-18-503.

     (6) The board shall:

     (a) advise the governor, legislature, and the department of transportation on the development of a long-range plan related to increasing commuter passenger rail services in the state;

     (b) assist in developing initiatives and strategies to encourage the development and use of intercity and commuter passenger rail service in the state; and

     (c) act as a liaison among the state, local governments, railroad industry, and the public.

     (7) The board is attached to the department of transportation for administrative purposes only.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 15, part 25, and the provisions of Title 2, chapter 15, part 25, apply to [section 1].



     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.



     NEW SECTION.  Section 4.  Termination. [This act] terminates July 1, 2011.
