A BILL FOR AN ACT ENTITLED: "AN ACT CLARIFYING THAT THE DEFINITION OF "FAMILY RESIDENTIAL UNIT" AS USED IN PROVISIONS CONCERNING SOLID WASTE MANAGEMENT AND LOCAL WATER QUALITY DISTRICTS MEANS STRUCTURES THAT CONTAIN INDOOR SEWER AND WATER FACILITIES; AND AMENDING SECTIONS 7-13-202 AND 7-13-4502, MCA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 7-13-202, MCA, is amended to read:

     "7-13-202.  Definitions. As used in this part, unless the context indicates otherwise, the following definitions apply:

     (1)  "Board" means the board of directors as provided for in 7-13-213.

     (2)  "Commissioners" means the board of county commissioners.

     (3)  "Family residential unit" means the residence of a single family that contains indoor sewer and water facilities.

     (4)  (a) "Solid waste" means all putrescible and nonputrescible wastes, including but not limited to garbage; rubbish; refuse; ashes; sludge from sewage treatment plants, water supply treatment plants, or air pollution control facilities; construction and demolition wastes; dead animals, including offal; discarded home and industrial appliances; and wood products or wood byproducts and inert materials.

     (b)  The term does not mean municipal sewage, industrial wastewater effluents, or mining wastes regulated under the mining and reclamation laws administered by the department of environmental quality, slash and forest debris regulated under laws administered by the department of natural resources and conservation, or marketable byproducts.

     (5)  "Solid waste management district" means an area established within a county for the purpose of planning and operating a solid waste management system as defined in 75-10-103."



     Section 2.  Section 7-13-4502, MCA, is amended to read:

     "7-13-4502.  Definitions. As used in this part, unless the context indicates otherwise, the following definitions apply:

     (1)  "Board of directors" means the board of directors provided for in 7-13-4516 or a joint board of directors provided for in 7-13-4527.

     (2)  "Board of environmental review" means the board of environmental review as provided in 2-15-3502.

     (3)  "Commissioners" means the board of county commissioners or the governing body of a city-county consolidated government.

     (4)  "Family residential unit" means a single-family dwelling that contains indoor sewer and water facilities.

     (5)  "Fee-assessed units" means all real property with improvements, including taxable and tax-exempt property as shown on the property assessment records maintained by the county, and mobile homes and manufactured homes as defined in 15-24-201.

     (6)  "Local water quality district" means an area established with definite boundaries for the purpose of protecting, preserving, and improving the quality of surface water and ground water in the district as authorized by this part."
