A BILL FOR AN ACT ENTITLED: "AN ACT DEDICATING THE INTEREST AND INCOME FROM $2 MILLION OF THE TOBACCO SETTLEMENT TRUST FUND TO PROVIDE GRANT FUNDS FOR PARTICIPATION OF CANCER PATIENTS IN NATIONAL CLINICAL DRUG TRIALS; AND PROVIDING AN EFFECTIVE DATE."



     WHEREAS, there is a consortium of medical and radiation oncologists in Montana that is community-based and that provides a method by which cancer patients may participate in state-of-the-art national clinical cancer research trials; and

     WHEREAS, funding from the National Cancer Institute provides only slightly more than one-half of the expenses of participation in the research trials and is limited by federal budget constraints, and other outside sources for funding are running out; and

     WHEREAS, many cancers are smoking- and tobacco-related, and an appropriate use of the tobacco settlement funds would be to support the efforts of participating in national clinical drug trials.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Tobacco trust -- interest allocation. The interest and income from $2 million of the Montana tobacco settlement trust fund provided for in Article XII, section 4, of the Montana constitution must be deposited in an account in the state special revenue fund to the credit of the department of public health and human services to be used for a grant to a consortium in Montana to provide for the administration of the participation in national clinical drug trials of Montanans who are cancer patients.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 17, chapter 6, and the provisions of Title 17, chapter 6, apply to [section 1].



     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2001.
