A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT THE LEGISLATURE MAY, IF IT FINDS THAT IT IS IN THE COMPELLING INTEREST OF THE STATE TO DO SO, PASS A BILL DECLARING THAT AN ACT OF THE UNITED STATES CONGRESS, A PRESIDENTIAL ORDER OR DECREE, A FEDERAL ADMINISTRATIVE RULE, OR A FEDERAL TREATY IS UNCONSTITUTIONAL AND OF NO FORCE OR EFFECT IN THE STATE OF MONTANA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Legislative nullification of federal law as applied to state. The legislature may, if it finds that it is in the compelling interest of the state to do so, pass a bill declaring that an act of the United States congress, a presidential order or decree, a federal administrative rule, or a federal treaty is unconstitutional and of no force or effect in the state of Montana.
