A BILL FOR AN ACT ENTITLED: "AN ACT CREATING A COMMITTEE TO REVIEW THE BUDGET DEVELOPMENT PROCESS USED TO CREATE THE BIENNIAL BUDGET REQUEST FOR PERSONAL SERVICES AND FOR BUDGET BASE DEVELOPMENT AND TO RECOMMEND A MORE EFFICIENT PROCESS FOR THE DEVELOPMENT OF THE PERSONAL SERVICES BUDGET AND BASE BUDGET REVIEW; REQUIRING THE COMMITTEE TO MAKE RECOMMENDATIONS TO THE LEGISLATIVE FINANCE COMMITTEE; AND PROVIDING AN EFFECTIVE DATE."



     WHEREAS, a major portion of the state budget is personal services; and

     WHEREAS, the state has been developing budgets for personal services in the same manner for at least 10 bienniums; and

     WHEREAS, a new statewide accounting, budgeting, and human resources system (SABHRS) is now in place for tracking and developing budgets; and

     WHEREAS, the staff of the Legislative Fiscal Division, the Office of Budget and Program Planning, and state agencies spend untold hours developing and amending personal services budgets; and

     WHEREAS, the Legislature does not have the authority to specify the number of state employees; and

     WHEREAS, the Legislature wants to maximize the efficient use of the state's new administrative systems and state employees; and

     WHEREAS, the current process all but automatically increases personal services budgets each biennium; AND

     WHEREAS, THE CURRENT PROCESS DOES NOT PROVIDE FOR AN ADEQUATE REVIEW OF EXPENDITURES IN THE BUDGET BASE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Review committee. (1) There is a review committee to develop recommendations to improve the efficiency of the process for developing and amending personal services budgets AND BASE BUDGET REVIEW.

     (2) The review committee consists of eight members appointed as follows:

     (a) two members of the staff of the legislative fiscal division appointed by the legislative fiscal analyst;

     (b) two members of the staff of the office of budget and program planning appointed by the budget director;

     (c) two members from the statewide accounting, budgeting, and human resources system (SABHRS) executive council or their designees; and

     (d)  one member of the house appropriations committee appointed by the speaker of the house and one member of the senate finance committee appointed by the president of the senate.

     (3) Technical staff support must be provided by the SABHRS support bureau of the information services division with the department of administration. The legislative fiscal division shall provide staff support for the committee.

     (4) Legislative members of the committee are entitled to compensation and expenses as provided in 5-2-302. The other members of the committee may receive reimbursement for travel and expenses.

     (5) The committee shall make recommendations to the legislative finance committee by April 30, 2002. The legislative finance committee may request any legislation necessary to implement the committee recommendations.



     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 2001.
