A BILL FOR AN ACT ENTITLED: "AN ACT APPROPRIATING MONEY TO THE DEPARTMENT OF FISH, WILDLIFE, AND PARKS FOR A FISH PASSAGE DEVICE AT THE CARTERSVILLE DIVERSION ON THE YELLOWSTONE RIVER; AND PROVIDING AN EFFECTIVE DATE AND A TERMINATION DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Appropriation. (1) There is appropriated $550,000 from the general fund to the department of fish, wildlife, and parks for the biennium beginning July 1, 2001.

     (2) (a) Subject to subsection (2)(b), the department of fish, wildlife, and parks may use the money appropriated under subsection (1) only to pay for costs associated with installing a fish passage device at the Cartersville diversion on the Yellowstone river, including a design and feasibility study.

     (b) The department may install the fish passage device only with the permission of the owner of the Cartersville diversion.



     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 2001.



     NEW SECTION.  Section 3.  Termination. [This act] terminates July 1, 2003.
