AN ACT ALLOWING ADMINISTRATIVE RULEMAKING AUTHORITY FOR LAWS NOT YET EFFECTIVE; AND PROVIDING THAT A RULE IS NOT EFFECTIVE UNTIL THE LAW IS EFFECTIVE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Rulemaking authority for laws not yet effective -- rule not effective until law effective. Unless otherwise provided in the statute, an agency may proceed with rulemaking under this chapter after the enactment of a statute to be implemented by rule, but a rule may not become effective prior to the effective date of the statute.



     Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 2, chapter 4, and the provisions of Title 2, chapter 4, apply to [section 1].
