A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR AN OPTIONAL BIDDING PREFERENCE FOR CITY OR TOWN RESIDENTS WITH RESPECT TO CITY OR TOWN CONTRACTS THAT ARE SUBJECT TO COMPETITIVE BIDDING PROCEDURES."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Optional bidding preference for municipal residents. (1) If there is not an out-of-state bidder for a contract subject to competitive bid under this part, the contract may be awarded to the lowest and best responsible bidder that is a city or town resident and that makes a bid that is not more than $500 or 3% higher, whichever is less, than the bid of the lowest responsible bidder that is not a city or town resident.

     (2) If there is one or more out-of-state bidders for a contract subject to competitive bid under this part, the state bid preference provided in 18-1-102 applies.

     (3) For the purposes of this section, "city or town resident" means a person, corporation, business, or other entity whose principal business location is within the boundaries of an incorporated city or town.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 7, chapter 5, part 43, and the provisions of Title 7, chapter 5, part 43, apply to [section 1].
