AN ACT PROVIDING THAT ALL MEMBERS OF THE HIGHWAY PATROL OFFICERS' RETIREMENT SYSTEM ARE ELIGIBLE FOR A FULL SERVICE RETIREMENT AFTER 20 YEARS OF SERVICE REGARDLESS OF AGE; AMENDING SECTION 19-6-501, MCA; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 19-6-501, MCA, is amended to read:

     "19-6-501.  Eligibility for service retirement benefit. (1) A member first employed by the Montana highway patrol on or before July 1, 1985, is eligible to receive a service retirement benefit after completing 20 years or more of membership service and terminating service.

     (2)  A member first employed by the Montana highway patrol after July 1, 1985, is eligible to receive a service retirement benefit when the member has reached age 50, completed 20 years or more of membership service, and terminated service."



     Section 2.  Effective date. [This act] is effective on passage and approval.
