A BILL FOR AN ACT ENTITLED: "AN ACT ELIMINATING THE EXEMPTION FROM OBTAINING PERMITS FOR SINGLE-FAMILY RESIDENCE HOMEOWNERS WHO INTEND TO INSTALL SANITARY PLUMBING AND POTABLE WATER SUPPLY PIPING THEMSELVES; CLARIFYING PLUMBING REPLACEMENT AND REPAIR ACTIVITIES FOR WHICH A PERMIT IS NOT REQUIRED; AND AMENDING SECTION 50-60-506, MCA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 50-60-506, MCA, is amended to read:

     "50-60-506.  Exceptions to permit requirement -- not applicable to single-family residence owner. (1) No A permit is not required for any minor replacement or repair work, the performance of which does not have a significant potential for creating a condition hazardous to public health and safety.

     (2)  (A) No A permit is not required where the installation is exempt under the provisions of 37-69-102 or 50-60-503, except that the installation of sanitary plumbing and potable water supply piping by the owner of a single-family residence requires a permit.

     (B) A PERMIT IS NOT REQUIRED BY THIS SUBSECTION (2) FOR PLUMBING-RELATED REPLACEMENT AND REPAIR WORK THAT INCLUDES BUT IS NOT LIMITED TO:

     (I) REPLACEMENT OF FIXTURES, FAUCETS, NONPOTABLE WATER SUPPLIES, AND TRAPS;

     (II) KIND-FOR-KIND REPLACEMENT OF PLUMBING COMPONENTS; AND

     (III) REPLACEMENT OF WATER HEATERS.

     (3)  No A state permit is not required whenever the installation occurs in an area governed by a municipality and where there is in effect a municipal building code which that covers plumbing installations and which that provides inspection procedures.

     (4)  Nothing contained in this part shall prohibit the owner of residential property from making an installation for all sanitary plumbing and potable water supply piping without a permit providing he does the work himself.

     (5)(4)  The provisions of this part do not apply to regularly employed maintenance personnel doing maintenance work on the business premises of their employer unless work is subject to the permit provisions of this part."
