A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT A PERSON WHO USES THE TERM "PLUMBER" OR "PLUMBING CONTRACTOR" IN CONNECTION WITH THE PERSON'S NAME, BUSINESS NAME, OR PLACE OF BUSINESS WHEN THE PERSON IS NOT LICENSED AS A MASTER PLUMBER IS SUBJECT TO THE REMEDIES AND PENALTY PROVISIONS OF SECTION 37-1-317, MCA, FOR PRACTICING WITHOUT A LICENSE; AND AMENDING SECTION 37-69-324, MCA."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     Section 1.  Section 37-69-324, MCA, is amended to read:

     "37-69-324.  Penalty -- definition. (1) A person is subject to the remedies and penalties established in 37-1-317 if the person:

     (a) who works at the field of plumbing or maintains or conducts a plumbing business or an individual who connects or disconnects plumbing from a public water or sewer system in violation of any provisions of this chapter or at a time when he the person is not exempt from the provisions of this chapter pursuant to the provisions of a duly an enacted and subsisting ordinance of a city or town; is guilty of a misdemeanor and, upon conviction thereof in any court of competent jurisdiction, is guilty of a misdemeanor

     (b)  uses in connection with the person's name, business name, or place of business the term "plumber" or "plumbing contractor" or represents in any way that the person is a plumber or plumbing contractor if the person is not a licensed master plumber; or

     (c)  violates the provisions of 37-69-402(1).

     (2) However, this chapter section may not be construed to apply to or affect plumbing or pipefitting as indicated in the 37-69-102 exceptions.

     (3)  For the purposes of this section, the term "person" means an individual, corporation, partnership, limited partnership, limited liability company, limited liability partnership, association, or other entity."
