A BILL FOR AN ACT ENTITLED: "AN ACT REVISING THE SALE OF TOBACCO PRODUCTS BY REQUIRING THAT TOBACCO PRODUCTS MAY BE DISPLAYED FOR SALE AND SOLD ONLY FROM BEHIND A SALES COUNTER THAT IS STAFFED BY AN OWNER OR SALESPERSON; AND PROVIDING AN EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Behind counter tobacco sales.  (1) Except as provided in 16-11-306 and subsection (2) of this section, tobacco products must be stored or displayed for sale and sold from behind sales counters staffed and supervised by the owner or an employee of the establishment.

     (2)  The provisions of subsection (1) do not apply to merchants or establishments whose only product line is tobacco products and tobacco-related products.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 16, chapter 11, part 3, and the provisions of Title 16, chapter 11, part 3, apply to [section 1].



     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2001.
