SENATE BILL NO. 372

A BILL FOR AN ACT ENTITLED: "AN ACT ESTABLISHING CERTAIN STANDING COMMITTEES OF THE LEGISLATURE; AND PROVIDING A DELAYED CONTINGENT EFFECTIVE DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  Standing committees. (1) During a regular session of the legislature convened in an odd-numbered year under Article V, section 6(1), of the constitution to consider legislation related to revenue or appropriations, the committees listed in subsection (2) are standing committees of the legislature. They are empowered to sit as committees and may act in their respective areas of responsibility.

     (2)  The following are committees of the legislature pursuant to subsection (1):

     (a)  in the senate:

     (i) finance committee;

     (ii) taxation committee;

     (iii) rules committee; and

     (iv) bills and journals committee;

     (b) in the house of representatives:

     (i) appropriations committee;

     (ii) taxation committee;

     (iii) rules committee; and

     (iv) bills and journals committee; and

     (c) a joint budget committee composed, pursuant to the joint rules of the legislature, of members of the senate finance committee and the house appropriations committee.

     (3) (a) The joint budget committee shall establish joint subcommittees as follows:

     (i) general government and transportation subcommittee;

     (ii) elected officials and labor subcommittee;

     (iii) health and human services subcommittee;

     (iv) natural resources subcommittee;

     (v) higher education subcommittee;

     (vi) education and commerce subcommittee;

     (vii) corrections and military affairs subcommittee; and

     (viii) long-range planning subcommittee.

     (b) The joint budget committee may establish other subcommittees pursuant to the joint rules of the legislature.

     (c) The jurisdiction of each subcommittee is as provided in the joint rules of the legislature.

     (d) All bills providing for an appropriation of money may first be considered by a subcommittee listed in subsection (3)(a).

     (4) (a) A senator who is not an officer of the senate or a member of the senate taxation committee is a member of the senate finance committee.

     (b) The provisions of subsection (4)(a) do not preclude any member of the senate from serving on any committee, as provided by the rules of the senate and the joint rules.

     (5) (a) A representative who is not an officer of the house of representatives or a member of the house taxation committee is a member of the house appropriations committee.

     (b) The provisions of subsection (5)(a) do not preclude any member of the house of representatives from serving on any committee, as provided by the rules of the house of representatives and the joint rules.

     (6) (a) The senate may establish committees in addition to the committees listed in subsection (2)(a).

     (b) The house of representatives may establish committees in addition to the committees listed in subsection (2)(b).

     (c) The senate and the house of representatives may establish joint committees in addition to the committee listed in subsection (2)(c).

     (7) This section applies only during a regular session of the legislature convened in an odd-numbered year under Article V, section 6(1), of the constitution.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 5, chapter 5, and the provisions of Title 5, chapter 5, apply to [section 1].



     NEW SECTION.  Section 3.  Coordination instruction. If [this act] is passed and approved and Senate Bill No. 123 is not approved by the electorate, then [this act] is void.



     NEW SECTION.  Section 4.  Contingent effective date. Subject to the provisions of [section 3], [this act] is effective October 1, 2003.
