A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT NONMETALLIC SHEATHED CABLE MAY NOT BE INSTALLED IN A COMMERCIAL BUILDING WHERE THE INSTALLATION WILL BE INACCESSIBLE; PROVIDING THAT IT IS A MISDEMEANOR TO ENERGIZE AN ELECTRICAL INSTALLATION UNLESS AN APPLICATION FOR AN INSPECTION TAG, TOGETHER WITH AN INSPECTION FEE, HAS BEEN FORWARDED TO THE DEPARTMENT OF COMMERCE OR TO INSTALL NONMETALLIC SHEATHED CABLE IN A COMMERCIAL BUILDING SO THAT THE INSTALLATION IS INACCESSIBLE; AND AMENDING SECTION 50-60-607, MCA."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
Section 1. Section 50-60-607, MCA, is amended to read:
"50-60-607. Unlawful acts -- penalty. (1) It is unlawful for a person, partnership, company, firm, association, or corporation other than a power supplier to energize an electrical installation under this part unless an application for an inspection tag covering the installation, together with the inspection fee, has been forwarded to the department of commerce.
(2) It is unlawful for a person, partnership, company, firm, association, or corporation to install nonmetallic sheathed cable (romex) in commercial buildings so that the cable installation is inaccessible, except during construction of the building when installation of the cable is needed for temporary power.
(3) A violation of a provision of subsection (1) or (2) is a misdemeanor."
