A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING AN INSURER FROM REQUIRING A HEALTH CARE PROVIDER, AS A CONDITION OF PARTICIPATION IN A HEALTH BENEFIT PLAN OF THE INSURER, TO PARTICIPATE IN ANY OF THE INSURER'S OTHER HEALTH BENEFIT PLANS; AND PROVIDING AN APPLICABILITY DATE."



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:



     NEW SECTION.  Section 1.  All products clauses prohibited. (1) An insurer may not require a health care provider, as a condition of participation in a health benefit plan of the insurer, to participate in any of the insurer's other health benefit plans.

     (2) In addition to the proceedings and penalties provided in this chapter for a violation of this section, a contract provision violating this section is void.



     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 33, chapter 18, part 2, and the provisions of Title 33, chapter 18, part 2, apply to [section 1].



     NEW SECTION.  Section 3.  Applicability. [This act] applies to all contracts between an insurer and a health care provider entered into or renewed after October 1, 2001.
