BY REQUEST OF THE DEPARTMENT OF JUSTICE

 

A BILL FOR AN ACT ENTITLED: "AN ACT INCREASING THE PENALTY FOR FAILURE TO STOP AND RENDER AID AT THE SCENE OF AN ACCIDENT INVOLVING INJURY TO OR DEATH OF ANY PERSON; AND AMENDING SECTION 61-7-103, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 61-7-103, MCA, is amended to read:

     "61-7-103.  Accidents involving death or personal injuries. (1) The driver of any a vehicle involved in an accident resulting in injury to or death of any person shall immediately stop such the vehicle at the scene of such the accident or as close thereto to the scene of the accident as possible, but and shall then forthwith immediately return to and in every event shall remain at the scene of the accident until he the person has fulfilled the requirements of 61-7-105. Every such A stop shall must be made without obstructing traffic more than is necessary.

     (2)  Any A person failing who fails to stop or to comply with said requirements under such circumstances subsection (1) shall upon conviction be punished by imprisonment for not less than 30 days or more than 1 year or by a fine of not less than $100 or more than $5,000 or by both such fine and imprisonment:

     (a) imprisoned in the county jail for a term not to exceed 6 months or be fined an amount not to exceed $500, or both, if the accident does not involve serious bodily injury to or death of any person;

     (b) imprisoned in a state prison for a term not to exceed 10 years or be fined an amount not to exceed $50,000, or both, if the accident involves serious bodily injury to or death of any person.

     (3)  The department shall revoke the license or, permit to drive, of any resident and any or nonresident operating privilege, as provided in 61-5-205, of any person so convicted for the period prescribed in of a violation of subsection (1), subject to the provisions of 61-5-208."
