A BILL FOR AN ACT ENTITLED: "AN ACT APPROPRIATING MONEY TO THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES FOR THE PURPOSE OF REIMBURSING COUNTIES FOR THE ADMINISTRATIVE COSTS OF ADMINISTERING AND PROVIDING PUBLIC ASSISTANCE IN EXCESS OF THE AMOUNT BUDGETED; AND PROVIDING AN EFFECTIVE DATE."
WHEREAS, for fiscal year 2000, the Department of Public Health and Human Services informed counties to budget 9% for the purpose of reimbursing the Department for the costs of administering and providing public assistance in each county; and
WHEREAS, after counties had set their budgets and imposed mill levies, the Department increased the administrative fee for fiscal year 2000 to 14% of the costs of administering and providing public assistance in each county.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Appropriation -- allocation. The amount of $225,609 is appropriated from the general fund to the department of public health and human services to be used to reimburse counties for administrative expenses charged to counties in excess of 9% for fiscal year 2000 for the cost of administering and providing public assistance in each county. If a county has not paid the administrative fee charged by the department, then the department may forego collecting the amount charged to the county in excess of 9%. A county remains liable to the department for administrative charges equal to 9% of the costs of administering and providing public assistance for fiscal year 2000.
NEW SECTION. Section 2. Effective date. [This act] is effective July 1, 2003.
