HOUSE BILL NO. 395

INTRODUCED BY K. GILLAN

A BILL FOR AN ACT ENTITLED: "AN ACT DIRECTING THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO WRITE OFF INDIRECT COSTS FOR PUBLIC ASSISTANCE ACTIVITIES BILLED TO YELLOWSTONE COUNTY FOR THE FISCAL YEAR ENDING JUNE 30, 2000; REQUIRING YELLOWSTONE COUNTY TO USE THE FUNDS FOR MENTAL HEALTH DROP-IN SERVICES; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

NEW SECTION.  Section 1.  Indirect cost writeoff. The department of public health and human services shall write off the $96,000 billed to Yellowstone County for indirect costs under the provisions of 53-2-304 and 53-2-322, in effect on June 30, 2000. Pursuant to those statutes, the department increased indirect costs from 9% to 14% for salary, travel, and administrative costs attributable to public assistance programs and other public assistance activity in the county. The state reduction for mental health drop-in services has caused Yellowstone County to incur additional costs for that service. The indirect costs billed to Yellowstone County and written off pursuant to this section must be used to maintain mental health drop-in services in Yellowstone County.

NEW SECTION.  Section 2.  Effective date. [This act] is effective on passage and approval.
