BY REQUEST OF THE HOUSE JOINT APPROPRIATIONS SUBCOMMITTEE ON LONG RANGE PLANNING

 

A BILL FOR AN ACT ENTITLED: "AN ACT AUTHORIZING THE USE OF MONEY IN THE STATE-TRIBAL ECONOMIC DEVELOPMENT COMMISSION GENERAL LICENSE STATE SPECIAL REVENUE ACCOUNT FOR A GRANT TO THE DEPARTMENT OF NATURAL RESOURCES AND CONSERVATION AND FEDERAL SPECIAL REVENUE FOR A SPECIAL PROJECTS PROJECT GRANT; PROVIDING AN APPROPRIATION TO THE DEPARTMENT OF FISH, WILDLIFE, AND PARKS; AMENDING SECTION 90-1-135, MCA; AND PROVIDING AN EFFECTIVE DATE AND A TERMINATION DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 90-1-135, MCA, is amended to read:

     "90-1-135.  (Temporary) Special revenue accounts. (1) There is an account in the state treasury for the receipt of state and private funds and an account in the state treasury for the receipt of federal funds for expenditure by the state-tribal economic development commission established in 90-1-131.

     (2)  Money Subject to [section 2], money in the accounts established in subsection (1) must be used to pay:

     (a)  the commission's administrative costs;

     (b)  the salary, benefits, and administrative expenses of the tribal business center coordinator and the federal grants coordinator; and

     (c)  the costs of conducting or commissioning and periodically updating or otherwise modifying a comprehensive assessment of economic development needs and priorities on each of the Indian reservations in the state.

     (3)  Money in the accounts that is not expended for the purposes identified in subsection (2) may be used for other purposes that the commission considers prudent or necessary.

     (4)  Interest and income earned on the money in the accounts must be deposited in the accounts for the commission's use.

     (5)  Money in the accounts that is not expended by June 30, 2005, must remain in the accounts for the commission's use. (Terminates June 30, 2005--sec. 5, Ch. 69, L. 2001.)"

 

     NEW SECTION.  SECTION 1.  OKI MAMII GRANT AUTHORIZED. THE DEPARTMENT MAY SPEND MONEY APPROPRIATED BY THE LEGISLATURE FROM THE GENERAL LICENSE ACCOUNT PROVIDED FOR IN 87-1-601 AND FEDERAL SPECIAL REVENUE TO FUND THE OKI MAMII GRANT TO TEACH IN THE AREAS OF WATER CONSERVATION AND IMPROVING FISH HABITAT ON THE BLACKFEET RESERVATION.

 

     NEW SECTION.  Section 2.  Appropriation -- purpose. There is appropriated from the state special revenue account provided for in 90-1-135, $20,000 to the department of natural resources and conservation. The department shall use the appropriation TO THE DEPARTMENT OF FISH, WILDLIFE, AND PARKS to fund a special project, THE Oki Mamii grant on the Blackfeet reservation to teach in the areas of water conservation and improving fish habitat:

     (1) $5,000 FROM THE GENERAL LICENSE ACCOUNT PROVIDED FOR IN 87-1-601; AND

     (2) $15,000 FROM FEDERAL SPECIAL REVENUE. The department shall follow the same reporting and payment procedures for disbursing this grant as it does for grant projects funded from the renewable resource projects account.

 

     NEW SECTION.  SECTION 3.  CODIFICATION INSTRUCTION. [SECTION 1] IS INTENDED TO BE CODIFIED AS AN INTEGRAL PART OF TITLE 87, CHAPTER 1, PART 6, AND THE PROVISIONS OF TITLE 87, CHAPTER 1, PART 6, APPLY TO [SECTION 1].

 

     NEW SECTION.  Section 4.  Effective date. [This act] is effective July 1, 2003.

 

     NEW SECTION.  Section 5.  Termination. [Section 1] terminates June 30, 2005.
