A BILL FOR AN ACT ENTITLED: "AN ACT DIRECTING THE BOARD OF REGENTS OF HIGHER EDUCATION TO REQUIRE THE REPAYMENT OF STATE SUBSIDIES RECEIVED UNDER THE WWAMI PROGRAM; PROVIDING FOR CONTRACT REQUIREMENTS GOVERNING THE REPAYMENT OF THE SUBSIDY; AND PROVIDING AN EFFECTIVE DATE AND AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  WWAMI subsidy repayment. It is the intent of the legislature that the board of regents of higher education require the repayment of student subsidies resulting from state participation in a professional education program offered in accordance with an interstate compact. The board of regents shall enter into a contract with a student entering the WWAMI program. The contract must provide for repayment of the state subsidy over a 10-year period that commences 6 months after the student terminates participation in the program. The contract must provide for 4% annual interest and must provide for graduated monthly payments. The graduated monthly payments must result in the final year payments being three times greater than the payments in the initial year. The board of regents shall offset the payments required under this section against any payments required under the rural physician incentive program provided for in Title 20, chapter 26, part 15.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 26, and the provisions of Title 20, chapter 26, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2003.

 

     NEW SECTION.  Section 4.  Applicability. [This act] applies to students entering the WWAMI program on or after July 1, 2003.
