A BILL FOR AN ACT ENTITLED: "AN ACT REVISING PROCEDURES RELATING TO THE UNAUTHORIZED PRACTICE OF LAW; PROVIDING A CRIMINAL PENALTY FOR THE UNAUTHORIZED PRACTICE OF LAW; AND AMENDING SECTION 37-61-210, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 37-61-210, MCA, is amended to read:

     "37-61-210.  Penalty for practicing without license. (1) If any a person practices law in any court, except a justice's court or a city court, without having received a license as attorney and counselor, he the person is guilty of a contempt of court the unauthorized practice of law.

     (2) A person convicted of the offense of unauthorized practice of law shall be fined an amount of not more than $500 or be imprisoned in the county jail for a term not to exceed 6 days, or both."
