A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING A DEFAULT SUPPLIER TO PROVIDE SMALL CUSTOMER CHOICE OF A RANGE OF SERVICE OPTIONS; ALLOWING THE PUBLIC SERVICE COMMISSION TO LIMIT CUSTOMER SWITCHING AMONG SERVICE OPTIONS; REQUIRING THE COMMISSION TO ADOPT RULES THAT DEFINE THE RANGE OF SERVICE OPTIONS, DEFINE RENEWABLE ENERGY RESOURCES, AND SET OUT PROCEDURES FOR SMALL CUSTOMERS SWITCHING AMONG THE RANGE OF SERVICE OPTIONS; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Public utility -- qualified choice for small customers -- commission rulemaking. (1) In addition to the customer choice provisions in 69-8-201, after January 1, 2004, a default supplier shall offer small customers a range of service options. The range of service options may include services that reflect:

     (a) market prices;

     (b) energy produced from new renewable energy resources; or

     (c) cost-based prices.

     (2) The commission may limit switching among the range of service options by small customers.

     (3) The commission shall adopt rules that:

     (a) define the range of service options;

     (b) set out the procedures for small customers switching among the range of service options; and

     (c) define renewable energy resources.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 69, chapter 8, part 2, and the provisions of Title 69, chapter 8, part 2, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.
