A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE VIII OF THE MONTANA CONSTITUTION TO REQUIRE THAT A STATE-IMPOSED PROPERTY TAX MUST BE REFUNDABLE UNLESS REFUNDING IS TEMPORARILY WAIVED BY THE ELECTORATE; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Article VIII of The Constitution of the State of Montana is amended by adding a new section 17 that reads:

     Section 17.  State property tax. (1) Except as provided in subsection (2), a tax on property imposed by the state must be wholly refundable as provided by law.

     (2) The electorate, at a statewide election, may waive the provisions of subsection (1) in whole or in part for a period not to exceed 4 years.

 

     NEW SECTION.  Section 2.  Effective date. If approved by the electorate, this amendment is effective January 1, 2005.

 

     NEW SECTION.  Section 3.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2004 by printing on the ballot the full title of this act and the following:

     []      FOR requiring that state-imposed taxes on property must be wholly refundable unless temporarily waived by the electorate.

     []      AGAINST requiring that state-imposed taxes on property must be wholly refundable unless temporarily waived by the electorate.
