     32-9-131. Access to records -- witnesses. For the purpose of this part, the department or the department's authorized representatives must be given free access to the offices and places of business and files of all licensees. The department or the department's authorized representative may require the attendance of any person and examine that person under oath relative to mortgage loans or related business or relative to the subject matter of any examination, investigation, or hearing and may require the production of books, accounts, papers, or records. In the event of disobedience to any subpoena or other process issued by the department or failure to produce any books, accounts, papers, or records, the department shall apply to the first judicial district court of Lewis and Clark County for an order requiring the evidence and testimony of witnesses and the production of books, accounts, papers, or records.
