A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING FOR A FUND TRANSFER TO EACH UNIT OF THE UNIVERSITY SYSTEM BASED UPON THE NUMBER OF RESIDENT STUDENTS ENROLLED IN AND ATTENDING THE UNIT; PROVIDING A LIMIT ON THE AMOUNT AVAILABLE FOR TRANSFER; APPROPRIATING THE AMOUNT TRANSFERRED TO THE UNIT; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Resident student payments -- fund transfers -- appropriation. (1) At the beginning of each school year BY THE 20TH CLASS DAY, the board of regents shall provide the department of administration with the number of resident students, as defined in 20-25-501, enrolled in and attending each unit of the university system listed in 20-25-201.

     (2) The department of administration shall transfer from the state general fund to each unit of the university system an amount equal to $500 times the number of resident students reported pursuant to subsection (1).

     (3) The fund transfers in subsection (2) may not exceed $26.8 million for the biennium ending June 30, 2009. If the amounts calculated in subsection (2) exceed the amount available for transfer, then the department shall prorate the transfers so that the $26.8 million limit is not exceeded.

     (4) The amounts transferred to each unit pursuant to subsections (2) and (3) are appropriated to that unit for the operations of the unit and are intended to be used to lower tuition costs.

 

     NEW SECTION.  Section 2.  Effective date. [This act] is effective July 1, 2007.
