A BILL FOR AN ACT ENTITLED: "AN ACT PROHIBITING CERTAIN ACTIVITIES WHILE DRIVING IN DEFINED AREAS."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Restricted use of electronic communication devices -- exception. (1) Except as provided in subsection (2), a person is restricted from the use of electronic communication devices, or any other activity that causes the driver to become inattentive to the immediate roadway and to pedestrians or other motorists, while driving on a public highway within first- and second-class cities, as defined in 7-1-4111, and in all school zones regardless of city population classification.

     (2) A person who is driving on any public highway that is a part of the federal-aid interstate system is exempt from the provisions in subsection (1).

     (3) A person who violates the provisions of this section is subject to the penalties provided in 61-8-711. A person who violates the provisions of this section within a school zone shall be fined double the fines provided in 61-8-711.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 61, chapter 8, part 3, and the provisions of Title 61, chapter 8, part 3, apply to [section 1].
