HOUSE BILL NO. 241

A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE LEGISLATIVE AUDIT COMMITTEE TO DRAFT AND INTRODUCE A SINGLE BILL EACH REGULAR LEGISLATIVE SESSION THAT IMPLEMENTS RECOMMENDATIONS MADE BY THE LEGISLATIVE AUDITOR; PROVIDING FOR TRANSITION; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Duties regarding audit recommendations. (1) Prior to November 1 immediately preceding each regular session of the legislature, the committee must have prepared for introduction into the next regular legislative session a single bill that implements the recommendations made by the legislative auditor pursuant to 5-13-304 or 5-13-307 since the last bill was prepared pursuant to this section if:

     (a) the recommendations can be implemented through the enactment, amendment, or repeal of law, including administrative rules;

     (b) the recommendations do not have a significant cost identified pursuant to 5-13-307(2); and

     (c) the committee concurs in the recommendations.

     (2) For the purposes of this section, "recommendations" includes comments and suggestions made under 5-13-307(1) and includes but is not limited to changes to law, including administrative rules, that will help to ensure that the objectives of audits of state agencies conducted by the legislative auditor, as stated in 5-13-308, are met.

     (3) (a) The committee may request the assistance of the staff of the legislative services division in preparing the bill required under subsection (1).

     (b) If the committee requests assistance under subsection (3)(a), staff of the legislative services division may request information that is necessary to draft the bill and the legislative auditor shall provide the information.

     (4) The bill required under subsection (1) must bear a statement that the bill is introduced "By Request of the Legislative Audit Committee", and the committee shall designate as the primary sponsor of the bill one of its members who will serve in the regular session of the legislature in which the bill is introduced.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 5, chapter 13, part 2, and the provisions of Title 5, chapter 13, part 2, apply to [section 1].

 

     NEW SECTION.  Section 3.  Transition. For the purposes of transition, the bill to be prepared by the legislative audit committee pursuant to [section 1] for introduction into the 61st legislative session includes all of the recommendations, as defined in [section 1], made by the legislative auditor pursuant to 5-13-304 or 5-13-307 after January 1, 2007.

 

     NEW SECTION.  Section 4.  Effective date. [This act] is effective on passage and approval.
