A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING ALLOWING THE DEPARTMENT OF TRANSPORTATION TO USE POSTCONSUMER RECYCLED GLASS IN ANY HIGHWAY CONSTRUCTION PROJECT WHEN FEASIBLE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Use of postconsumer PROCESSED recycled glass in highway construction projects. (1) The department shall MAY, whenever feasible, use crushed postconsumer recycled glass PROCESSED INTO GLASS CULLET in federal, AND state, and local highway construction projects, including but not limited to use as:

     (a) backfill ROADWAY FILL MATERIAL;

     (b) roadfill ROADWAY AGGREGATES;

     (c) fill around culverts; and BEDDING MATERIAL;

     (d) a component of concrete, known in final product form as "glascrete" FOUNDATION MATERIAL; AND

     (E) FILTER MATERIAL.

     (2) The department shall MAY take procedural steps with the incorporation of postconsumer recycled glass GLASS CULLET into any highway construction project to ensure that:

     (a) purchasing measures are able to procure sizable amounts of recycled glass to meet set project deadlines ROAD CONSTRUCTION PROJECTS USE GLASS CULLET WHEN IT IS LOCALLY AVAILABLE AND ECONOMICALLY FEASIBLE TO INCORPORATE INTO THE PROJECT; and

     (b) engineering standards demonstrate the viability of postconsumer recycled glass for each project that it is used in ACCEPTABLE USE OF GLASS CULLET FOR A PROJECT.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 60, chapter 2, part 2, and the provisions of Title 60, chapter 2, part 2, apply to [section 1].
