A BILL FOR AN ACT ENTITLED: "AN ACT INSTITUTING A MORATORIUM ON THE SALE OF MILK PRODUCTS DERIVED FROM CLONED ANIMALS AND MEAT FROM THE OFFSPRING OF CLONED ANIMALS; PROVIDING A CIVIL PENALTY; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A TERMINATION DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Moratorium on sale of cloned meat and milk products -- penalty. (1) The sale of milk products derived from cloned animals and meat from the offspring of cloned animals is prohibited. As used in the section, "cloned" means an animal that is produced when the nucleus is removed from an egg cell, a new nucleus from an adult cell is injected, and the resulting embryo is implanted into a surrogate female animal, resulting in a nearly identical genetic copy of the adult progenitor.

     (2) A person who sells milk products or meat from cloned animals in violation of subsection (1) is subject to a civil fine not to exceed $500.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 50, chapter 31, part 5, and the provisions of Title 50, chapter 31, part 5, apply to [section 1].

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.

 

     NEW SECTION.  Section 4.  Termination. [This act] terminates on the date that the U.S. food and drug administration formally declares that milk from cloned animals and meat from the offspring of cloned animals is safe for human consumption. The director of the department of public health and human services shall certify to the governor in writing and notify the code commissioner in writing when that federal declaration occurs.
