A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO REPORT TO THE CHILDREN, FAMILIES, HEALTH, AND HUMAN SERVICES LEGISLATIVE INTERIM COMMITTEE ON THE DEPARTMENT'S PROGRESS IN MEETING SPECIFIED GOALS AND PERFORMANCE INDICATORS AND TO POST THOSE GOALS AND PERFORMANCE INDICATORS ON THE DEPARTMENT'S WEBSITE; ALLOWING THE DEPARTMENT TO AMEND THOSE GOALS AND PERFORMANCE INDICATORS AND ITS PROGRESS REPORTS UNDER CERTAIN CONDITIONS; SPECIFYING GOALS AND PERFORMANCE INDICATORS FOR THE DEPARTMENT; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE AND A TERMINATION DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Department to report annual goals and performance indicators. (1) The department of public health and human services shall report to the children, families, health, and human services interim committee of the legislature and shall post on the department's website the goals and performance indicators for the past, present, and future fiscal years in the format provided in [section 2].

     (2) The department shall use its best efforts to achieve optimum figures for the goals and performance indicators provided in [section 2]. If the department is unable to achieve a goal or performance indicator, it shall, before the beginning of the fiscal year for the goal or performance indicator in question, provide notice of that fact to the children, families, health, and human services interim committee and place the notice on the department's website. The department shall also notify the children, families, health, and human services interim committee and place a notice on the department's website if the department:

     (a) makes an addition to the goals and performance indicators already reported and posted in accordance with [section 2] and subsection (1) of this section;

     (b) fills in, in the goals and performance indicators reported and posted in accordance with [section 2] and subsection (1) of this section, a goal or performance indicator left blank by the legislature; or

     (c) makes an adjustment, as required by a budget approved by the legislature, to a goal or performance indicator previously reported and posted in accordance with [section 2] and subsection (1) of this section.

 

     NEW SECTION.  Section 2.  Content and format of department goals and performance indicators. The department of public health and human services' goals and performance indicators must include and be reported in a format that shows:

     (1) reading horizontally left to right across the top of the page, a column for showing the goals and performance indicators required by subsection (2) for the following fiscal years:

     (a) the actual figure for fiscal year 2004;

     (b) the actual figure for fiscal year 2005;

     (c) the actual figure for fiscal year 2006;

     (d) the estimated figure for fiscal year 2007;

     (e) the department request for fiscal year 2008;

     (f) the legislative request for fiscal year 2008;

     (g) the department request for fiscal year 2009; and

     (h) the legislative request for fiscal year 2009; and

     (2) reading vertically top to bottom down the left margin of the page, a column that includes the following goals and performance indicators:

     (a) division 02 (human and community services):

     (i) the pounds of food delivered to Indian reservations, elderly feeding sites, charitable organizations, and soup kitchens, in millions of pounds;

     (ii) the number of low-income homes weatherized;

     (iii) the number of households provided with energy assistance;

     (iv) achievement of the all-family work participation rate necessary to qualify for the 75% state maintenance of effort;

     (v) achievement of the two-parent work participation rate necessary to qualify for the 75% state maintenance of effort;

     (vi) the number of low-income working families receiving child-care assistance;

     (vii) the number of meals served by the child and adult care food program;

     (viii) the number of Indian tribes running their own FAIM (families achieving independence in Montana) program;

     (ix) the recipient job retention rate;

     (x) the recipient wage gain rate;

     (xi) the recipient job entry rate; and

     (xii) the percentage of licensed child-care facilities and homes with no violations during the license year;

     (b) division 03 (child and family services):

     (i) the total number of unduplicated children in out-of-home care at some time throughout the year;

     (ii) the number of children entering care;

     (iii) the number of children leaving care;

     (iv) the number of finalized subsidized adoptions in the year;

     (v) the average number of placements per child each year;

     (vi) the total number of families served by in-home services programs;

     (vii) the average length of time, in days, that children remain in out-of-home placements;

     (viii) the number of permanent placements;

     (ix) the number of times that extended families have been used for kinship placements;

     (x) the caseload of caseworkers;

     (xi) the percentage of children whose permanent placement is the home from which they were removed; and

     (xii) the number of foster care families used in the year;

     (c) division 04 (director's office):

     (i) the number of projects worked on;

     (ii) new federal revenue:

     (A) hospital utilization fee;

     (B) the ICF/MR (intermediate care facility/mental retardation) utilization fee;

     (C) the amount of nursing home bed tax revenue collected;

     (D) ambulance IGT (intergovernmental transfer);

     (E) targeted case management CFSD (child and family services division); and

     (F) recovery of Title IV-E administrative funds;

     (iii) general fund savings:

     (A) retroactive eligibility--medicaid;

     (B) medicaid rehabilitation services; and

     (C) medicaid--forensic patients;

     (iv) the number of FTE (full-time equivalent);

     (v) the number of employees;

     (vi) the number of new hires;

     (vii) the number of classification reviews;

     (viii) the number of workers' compensation claims processed;

     (ix) the number of ERTW (early return to work) coordinated claims;

     (x) the number of threat reports received; and

     (xi) the number of trainings conducted (safety, policy, and new employee);

     (d) division 05 (child support enforcement):

     (i) the percentage of child support cases in enforcement proceedings;

     (ii) the amount of child support collections, in dollars;

     (iii) the percentage of paternity establishment;

     (iv) the percentage of cases with support orders;

     (v) the percentage of cases with current support collection; and

     (vi) the percentage of cases with arrears collections;

     (e) division 06 (fiscal services):

     (i) the total number of payments processed;

     (ii) the amount of reimbursement collections, in dollars;

     (iii) the number of reimbursed claims processed;

     (iv) the number of accountable grants and funds;

     (v) a statement of the major audit recommendations by the legislative auditor;

     (vi) the number of major audit recommendations not implemented by the department; and

     (vii) administrative costs as a percent of total agency costs;

     (f) division 07 (public health and safety):

     (i) the number of clients served by WIC (women, infants, and children) program;

     (ii) net food costs for WIC;

     (iii) low birth weight rate; and

     (iv) infant mortality rate;

     (g) division 08 (quality assurance):

     (i) the number of state health care licensure visits; and

     (ii) the amount of medicaid TPL (third-party liability) cost avoidance cash recoveries and lien and estate collections, in dollars;

     (h) division 09 (operations and technology):

     (i) the number of birth and death certificates issued online;

     (ii) the number of information systems work orders completed;

     (iii) external systems--transactions:

     (A) TEAMS (temporary economic assistance management systems);

     (B) SEARCHS (systems for enforcement and recovery of child support); and

     (C) CAPS (child and adult protection services);

     (iv) the number of leases managed;

     (v) the number of medicaid payments issued;

     (vi) the number of medicaid claims processed;

     (vii) the number of computers supported;

     (viii) the number of servers managed;

     (ix) the Montana access program EBT (electronic benefits transfer):

     (A) food stamps:

     (I) the number of payments; and

     (II) the amount, in dollars;

     (B) TANF (temporary assistance to needy families):

     (I) the number of payments; and

     (II) the amount, in dollars;

     (C) child support payments:

     (I) the number of payments; and

     (II) the amount, in dollars; and

     (x) information technology cost as a percentage of total agency costs;

     (i) division 10 (disability services):

     (i) the number of vocational rehabilitation clients rehabilitated;

     (ii) the number of vocational rehabilitation clients severely disabled;

     (iii) the number of developmental disabilities clients waiting for service and receiving no other DDP (developmental disabilities program) services;

     (iv) the number of developmental disabilities clients waiting for additional services and receiving some DDP services;

     (v) MTAP (Montana telecommunications access program) service total minutes a year;

     (vi) the percentage of clients vocationally rehabilitated who are satisfied with the services provided;

     (vii) the number of disability determination bureau claims processed accurately rate (as a percentage of all claims);

     (viii) the percentage of claims processed within 60 days; and

     (ix) the number of claims adjudicated within 1 year;

     (j) division 11 (health resources):

     (i) for children's mental health, the percentage of SED (severely emotionally disabled) clients served in the community;

     (ii) for CHIP (childrens' health insurance program) and special health, the percentage of clients served receiving preventive health care;

     (iii) for managed care, the percentage of participation in the nurse first-care management programs;

     (iv) the number of emotionally disturbed children who improve their level of functioning;

     (v) the number of children with substance abuse who complete treatment; and

     (vi) the number of children with substance abuse who are drug-free during the 12 months following completion of treatment;

     (k) division 22 (senior and long-term care):

     (i) the number of persons receiving personal assistance;

     (ii) the number of persons receiving HCBS (home- and community-based services) waiver services;

     (iii) the number of persons receiving nursing home care;

     (iv) the percentage of nursing home facilities with deficiencies that pose a serious threat to the health, safety, or welfare of the public; and

     (v) the percentage of assisted living facilities with deficiencies that pose a serious threat to the health, safety, or welfare, of the public; and

     (l) division 33 (addictive and mental disorders):

     (i) for the chemical dependency program, the number of unduplicated individuals in treatment;

     (ii) for the adult mental health medicaid program, the number of unduplicated people served;

     (iii) the number of adults treated that are drug-free during the 12 months following completion of treatment;

     (iv) the number of individuals who complete treatment;

     (v) the number of persons treated at Warm Springs;

     (vi) the number of times capacity was exceeded at Warm Springs;

     (vii) the readmission rate at Warm Springs;

     (viii) the percentage of patients with a continuum of care plan after discharge;

     (ix) the percentage suicide rate in Montana for all ages;

     (x) medicaid growth rates;

     (xi) medicaid reimbursement rates to primary care providers; and

     (xii) home health care average wages.                

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective on passage and approval.

 

     NEW SECTION.  Section 4.  Termination. [This act] terminates June 30, 2009.
