A BILL FOR AN ACT ENTITLED: "AN ACT SUBMITTING TO THE QUALIFIED ELECTORS OF MONTANA AN AMENDMENT TO ARTICLE IV, SECTION 5, OF THE MONTANA CONSTITUTION REQUIRING THAT ALL ELECTED OFFICIALS THE GOVERNOR, LIEUTENANT GOVERNOR, SECRETARY OF STATE, ATTORNEY GENERAL, SUPERINTENDENT OF PUBLIC INSTRUCTION, AUDITOR, MEMBERS OF THE LEGISLATURE, PUBLIC SERVICE COMMISSIONERS, SUPREME COURT JUSTICES, AND DISTRICT COURT JUDGES BE ELECTED BY A MAJORITY OF VOTES; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Article IV, section 5, of The Constitution of the State of Montana is amended to read:

            "Section 5.  Result of elections. (1) In EXCEPT AS PROVIDED IN SUBSECTION (2), IN all elections held by the people, the person or persons receiving the largest number majority LARGEST NUMBER of votes shall be declared elected.

     (2) IN ELECTIONS FOR GOVERNOR, LIEUTENANT GOVERNOR, SECRETARY OF STATE, ATTORNEY GENERAL, SUPERINTENDENT OF PUBLIC INSTRUCTION, AUDITOR, MEMBER OF THE LEGISLATURE, PUBLIC SERVICE COMMISSIONER, SUPREME COURT JUSTICE, AND DISTRICT COURT JUDGE, THE PERSON RECEIVING THE MAJORITY OF VOTES SHALL BE DECLARED ELECTED."

 

     NEW SECTION.  Section 2.  Effective date. This amendment is effective upon approval by the electorate.

 

     NEW SECTION.  Section 3.  Submission to electorate. This amendment shall be submitted to the qualified electors of Montana at the general election to be held in November 2008 by printing on the ballot the full title of this act and the following:

     []      FOR requiring that all elected STATE officials be elected by a majority of votes.

     []      AGAINST requiring that all elected STATE officials be elected by a majority of votes.
