HOUSE BILL NO. 705

A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT THE BOARD OF LIVESTOCK AND THE DEPARTMENT OF LIVESTOCK MAY NOT ACTIVELY PROMOTE A STATE OR A FEDERAL ANIMAL IDENTIFICATION PREMISES REGISTRATION SYSTEM; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. National animal identification -- premises registration phase. (1) The board of livestock and the department may not actively promote a state or a federal animal identification premises registration system.
(2) For the purposes of this section:
(a) "actively promote" means:
(i) to hold meetings at which the primary purpose of the meeting, as described in any public notice, is to discuss an animal identification premises registration system;
(ii) distribute printed material or publications regarding an animal identification premises registration system unless the information is requested by a premises owner; or
(iii) advertise the availability or the requirements of an animal identification premises registration program through other media outlets; and
(b) "premises" means a location for food animal production that is operated by an entity participating in food animal production and that is distinct from other livestock production units.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 81, chapter 1, and the provisions of Title 81, chapter 1, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective on passage and approval.
