A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THAT EACH PUBLIC OR PRIVATE SCHOOL IN MONTANA PROVIDE PARENTS OR GUARDIANS OF CERTAIN STUDENTS WITH INFORMATION ABOUT THE LINK BETWEEN HUMAN PAPILLOMAVIRUS AND CERVICAL CANCER AND THE AVAILABILITY OF A HUMAN PAPILLOMAVIRUS VACCINE; REQUIRING THE DEPARTMENT OF PUBLIC HEALTH AND HUMAN SERVICES TO PREPARE THE INFORMATIONAL MATERIALS; REQUIRING SCHOOLS TO ISSUE A YEARLY REPORT TO THE DEPARTMENT; AND PROVIDING AN EFFECTIVE DATE."

 

     WHEREAS, 10,000 women are diagnosed with cervical cancer each year in the United States; and

     WHEREAS, 3,700 women die each year from cervical cancer in the United States; and

     WHEREAS, 99% of cervical cancer cases are linked to the human papillomavirus (HPV); and

     WHEREAS, the Advisory Committee on Immunization Practices of the U.S. Department of Health and Human Services recommends HPV vaccines for 11-year-old and 12-year-old girls.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Information for prevention of cervical cancer. (1) In the initial year of operation, the parents or guardians of each female student entering the 6th through 12th grades at any public or private school in the state of Montana must be provided with information about the link between human papillomavirus and cervical cancer and the availability of a human papillomavirus vaccine. After the first year of operation, that information must be provided to the parents and guardians of female students entering 6th grade. The information must include:

     (a) the causes and symptoms of human papillomavirus, how it is spread, and the places where parents and guardians may obtain additional information and vaccinations for their children; and

     (b) current recommendations from the United States centers for disease control and prevention regarding the receipt of vaccines for human papillomavirus and where the vaccination can be received.

     (2) The department shall prepare the informational materials and shall consult with the office of public instruction. The office of public instruction shall provide the materials to each public or private school in Montana.

 

     NEW SECTION.  Section 2.  Reporting. (1) Each public or private school in the state of Montana shall, as part of its yearly medical recordkeeping procedures, provide for the reporting of and keep a record of all female students who have received the human papillomavirus vaccination.

     (2) Each school shall submit an annual report of the information required under subsection (1) to the department.

 

     NEW SECTION.  Section 3.  Codification instruction. [Sections 1 and 2] are intended to be codified as an integral part of Title 50, chapter 1, part 2, and the provisions of Title 50, chapter 1, part 2, apply to [sections 1 and 2].

 

     NEW SECTION.  Section 4.  Effective date. [This act] is effective July 1, 2007.
