A BILL FOR AN ACT ENTITLED: "AN ACT RELATING TO LAWS GOVERNING ANNEXATION IN WHICH THE PUBLIC DOES NOT HAVE THE RIGHT OF PETITION OR PROTEST; AND PROHIBITING ANNEXATION IN A COUNTY IN WHICH THE MUNICIPALITY DOES NOT EXERCISE JURISDICTION UNLESS THE PROPERTY PROPOSED TO BE ANNEXED IS INCLUDED IN A GROWTH POLICY OR PORTION OF A GROWTH POLICY ADOPTED BY THE MUNICIPALITY AND THE COUNTY."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Restrictions on annexation. In instances of annexation allowed under this part, a municipality may not annex property in a county in which the municipality does not exercise municipal jurisdiction unless the property proposed to be annexed is included in either a growth policy or the neighborhood plan portion of a growth policy adopted pursuant to Title 76, chapter 1, part 6, by both the municipality proposing the annexation and the county in which the property is located.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 7, chapter 2, parts 42 and 45, and the provisions of Title 7, chapter 2, parts 42 and 45, apply to [section 1].
