A BILL FOR AN ACT ENTITLED: "AN ACT APPROPRIATING FUNDS TO BE DISTRIBUTED AS GRANTS TO CITIES, TOWNS, AND COUNTIES FOR THE PURPOSE OF CONSTRUCTING, REPAIRING, REHABILITATING, MAINTAINING, AND ACQUIRING CERTAIN PUBLIC FACILITIES AND CERTAIN CAPITAL EQUIPMENT; AND PROVIDING AN EFFECTIVE DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Appropriation for local public facilities -- allocation of funds. (1) (a) There is appropriated from the general fund to the department of commerce for the fiscal biennium beginning July 1, 2007, $40 million to be distributed as provided in subsection (2) to county, municipal, and consolidated governments for the construction, repair, rehabilitation, maintenance, and acquisition of public facilities and capital equipment.

     (b) A county, municipality, or consolidated government may contract with or make a grant to a public or private entity to accomplish the purposes of this section.

     (2) Of the $40 million appropriated in subsection (1):

     (a) $20 million must be distributed among incorporated cities and towns in the ratio that the population within the corporate limits of the city or town bears to the total population within corporate limits of all the cities and towns in Montana; and

     (b) $20 million must be distributed among the counties as follows:

     (i) $250,000 to each county; and

     (ii) the remaining $6 million in the ratio that the population outside the corporate limits of cities and towns within the county bears to the total population outside the corporate limits of all the cities and towns in Montana.

     (3) The department of commerce shall distribute the funds as soon as practicable after [the effective date of this act] but not later than August 1, 2007.

     (4) For the purposes of this section:

     (a) "capital equipment" means police, fire, emergency response, or emergency medical rescue vehicles;

     (b) "population" means the number of inhabitants as determined by an official federal, state, or local census or official population estimate approved by the department of commerce;

     (c) "public facility" means:

     (i) a water supply production, treatment, storage, or distribution facility;

     (ii) a wastewater collection, treatment, or disposal facility;

     (iii) a transportation facility, including roads, streets, bridges, rights-of-way, traffic signals, overpasses, underpasses, and landscaping;

     (iv) a storm water collection, retention, detention, treatment, or disposal facility or a flood control facility; and

     (v) a police, emergency medical rescue, or fire protection facility.

 

     NEW SECTION.  Section 2.  Notification to tribal governments. The secretary of state shall send a copy of [this act] to each tribal government located on the seven Montana reservations and to the Little Shell Chippewa tribe.

 

     NEW SECTION.  Section 3.  Effective date. [This act] is effective July 1, 2007.
