A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING CERTAIN VEHICLES TO SECURE LOADS TO PREVENT LITTER AND DEBRIS ON PUBLIC HIGHWAYS; AND AMENDING SECTION 61-8-370, MCA."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     Section 1.  Section 61-8-370, MCA, is amended to read:

     "61-8-370.  Securing of load -- requirement. (1) Except as provided in subsection (2), A a person operating may not drive or move a loaded vehicle on a public highway unless the vehicle is constructed or loaded in a manner to prevent any of its load from escaping from the vehicle for the purpose of transporting solid waste as defined in 75-10-203, except a commercial motor vehicle or a vehicle transporting unprocessed agricultural products, shall attach, cover, or otherwise secure the load sufficiently in order to prevent littering or creating an obstruction dangerous to the public traveling on the highway.

     (2) The following vehicles are exempt from the provisions in subsection (1):

     (a) a commercial motor vehicle;

     (b) a vehicle transporting agricultural products;

     (c) a vehicle performing road maintenance;

     (d) a vehicle providing emergency or disaster relief services;

     (e) a vehicle traveling to and from a marked construction zone."
