SENATE BILL NO. 297

A BILL FOR AN ACT ENTITLED: "AN ACT MAKING STATE-FUNDED REINSURANCE FOR HEALTH CARE COSTS AVAILABLE TO SCHOOL DISTRICTS; AND PROVIDING AN EFFECTIVE DATE."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. School district health reinsurance coverage. (1) The state shall make available to school districts state-funded reinsurance under which the state is responsible for covering health care costs from $150,000 to $1 million per claim for an individual. This reinsurance is available only for active employees and their spouses and dependents. Spouses and dependents may participate on a self-pay basis for a fee established by the department of administration. A school district must enter into a contract with the department of administration in order to receive the reinsurance coverage and other benefits described in this section.
(2) The department of administration shall provide case management services to help school districts manage high-cost claims in order to provide the best care for the patient while controlling costs to the school district.
(3) The department of administration shall provide technical assistance to school districts to assist the districts in making informed decisions about purchasing health care coverage.
NEW SECTION. Section 2. Codification instruction. [Section 1] is intended to be codified as an integral part of Title 20, chapter 9, and the provisions of Title 20, chapter 9, apply to [section 1].
NEW SECTION. Section 3. Effective date. [This act] is effective July 1, 2007.
