SENATE BILL NO. 548

A BILL FOR AN ACT ENTITLED: "AN ACT PROVIDING THAT CERTIFIED ROSTERS FOR USE IN THE ORGANIZATION OF THE MONTANA SENATE AND HOUSE OF REPRESENTATIVES BE PREPARED FROM THE REPORT OF THE CANVASS CERTIFIED AND FILED IN THE OFFICE OF THE SECRETARY OF STATE; REQUIRING THAT THE REPORT OF THE CANVASS INCLUDE THE INDIVIDUAL'S PARTY AFFILIATION; AND AMENDING SECTIONS 5-2-211 AND 13-15-506, MCA."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
Section 1. Section 5-2-211, MCA, is amended to read:
"5-2-211. Certified rosters. The secretary of state shall prepare certified rosters from the official election records on file report of the canvass as it was certified and filed in his the secretary of state's office pursuant to 13-15-506 for use in the organization of the senate and house of representatives."
Section 2. Section 13-15-506, MCA, is amended to read:
"13-15-506. Report of the canvass. (1) The secretary of the board shall prepare, certify, and file in the official records of his the secretary of state's office a report of the canvass which that lists:
(a) the total number of electors voting in each county and in each legislative house district and the total in the state;
(b) the name of each individual receiving votes, the individual's party affiliation, if any, as it appeared on the ballot, and the office for which the votes were received;
(c) the number and title of each ballot issue; and
(d) the votes by county and legislative house district and the total votes for each individual and for and against each ballot issue.
(2) Write-in votes for an individual shall must be entered in the report in the same place as votes of other individuals for the same office but shall must be identified as write-in votes."
