A BILL FOR AN ACT ENTITLED: "AN ACT REQUIRING THE SELLER OF REAL PROPERTY WITH A SEPTIC TANK TO PROVIDE WRITTEN EVIDENCE TO THE BUYER THAT THE TANK WAS PUMPED WITHIN 3 YEARS PRIOR TO THE SALE; AND PROVIDING AN APPLICABILITY DATE."

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

 

     NEW SECTION.  Section 1.  Notice of pumping of septic system upon sale of real property. Upon the sale or transfer of ownership of real property containing one or more septic tanks as part of an onsite septic system, the seller shall provide written evidence to the buyer that liquid and solid material in the septic tanks has been pumped within 3 years prior to the sale or transfer. The pumping of a septic tank must be in compliance with the provisions of Title 75, chapter 10, part 12.

 

     NEW SECTION.  Section 2.  Codification instruction. [Section 1] is intended to be codified as an integral part of Title 70, and the provisions of Title 70 apply to [section 1].

 

     NEW SECTION.  Section 3.  Applicability. [This act] applies to the sale or transfer of real property made on or after [the effective date of this act].
