A BILL FOR AN ACT ENTITLED: "AN ACT PROTECTING THE PROPERTY RIGHTS OF MONTANA DOG OWNERS BY PROHIBITING COUNTY AND MUNICIPAL GOVERNING BODIES FROM ENACTING OR ENFORCING REGULATIONS THAT ARE SPECIFIC TO A BREED OF DOG."
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:
NEW SECTION. Section 1. Breed-specific dog regulation prohibited. The governing body of a county may not enact or enforce an ordinance, policy, resolution, or other regulation that is specific as to the breed or perceived breed of a dog, CANIS FAMILIARIS. This section does not restrict the authority of the governing body to enact an ordinance as provided in part 1 or this part that applies to all dogs AND DOG HYBRIDS WITH WOLVES, COYOTES, OR JACKALS.

The governing body of a city or town may not enact or enforce an ordinance, policy, resolution, or other regulation that is specific as to the breed or perceived breed of a dog, CANIS FAMILIARIS. This section does not restrict the authority of the governing body to enact an ordinance as provided in part 1 or this part that applies to all dogs AND DOG HYBRIDS WITH WOLVES, COYOTES, OR JACKALS.
NEW SECTION. Section 3. Codification instruction. (1) [Section 1] is intended to be codified as an integral part of Title 7, chapter 23, part 21, and the provisions of Title 7, chapter 23, part 21, apply to [section 1].
(2) [Section 2] is intended to be codified as an integral part of Title 7, chapter 23, part 41, and the provisions of Title 7, chapter 23, part 41, apply to [section 2].
